Terms and Conditions of Sale
The following terms and conditions of sale govern the sale of wine and any other wine product sold by the company “Az.Agr. Francesco RADINO srl” on “www.radino.it”.
All the products purchased on www.radino.it are directly sold by “Az.Agr. Francesco RADINO srl” (hereinafter called “Radino”),with its registered office at Rione Vetera, 84 –75100 Matera – MT- Italy, registered in the business register of Matera under tax code and VAT Number 01871400766 , fully paid-up share capital of 100.000,00 Euros.
1. RADINO BUSINESS POLICY
1.1 1.1 Radino offers a range of wines for sale on www.radino.it. Its e-commerce business services are governed by the rules and regulations applied to e-commerce and is reserved to its end users who are over 18 (eighteen) and fit the definition of “consumers”.
1.2 “Consumer” shall mean any individual who is purchasing the Products on sale on www.Radino.it or is acting for purposes which are outside his or her trade, business or profession. If you are not a “consumer” and have any enquiries please contact Radino’s Commercial Department at email@example.com.
1.3 1.3 In compliance with the laws in force governing the purchase of wine and spirits as well as with its business policy, Radino reserves the right not to process any orders submitted by users who do not qualify as “Consumers” and do not have the minimum age provided for by the law for the purchase and delivery of wine and spirits. Radino does not sell either wine or spirits to people under 18. By using www.radino.it, you declare to be over 18 and that also the recipient of the goods is over 18.
1.4 1.4 Radino’s terms and conditions of sale govern exclusively the supply, transmission, acceptance, shipping, purchasing and the right to withdraw from any purchase orders relating to products sold on www.collebello.it between the users of Collebello.it and “Az.Agr. Francesco Radino srl”.
1.5 Radino’s terms and conditions of sale do not govern the supply of services or the sale of products performed
by third parties other than Radino, which may be on www.radino.it through links, banners or other hypertext links. Before purchasing products or services from third parties other than Radino, the Company recommends that you check the third party’s terms and conditions of sale. In fact, Radino shall not be deemed liable for either the supply of services by third parties other than “Az. Agr. Francesco Radino srl” or for the execution of e-commerce transactions carried out between the users of www.radino.it and third parties. 2. RADINO’S SALES CONTRACT
2.1 2.1 In order to enter into a purchase contract relating to one or more products sold on www.radino.it, it is necessary to fill out the online purchase order and keep to the relative instructions. The order form contains a summary of these terms and conditions of sale, such as the price, the terms and conditions of delivery and payment as well as any additional information on the main characteristics of the product ordered.
2.2 2.2 Radino’ sales contract is to be deemed concluded when Radino acknowledges receipt of the order form by e-mail, checks that your data are correct and sends you back an acknowledgment of receipt of the purchase order, including the summary of the main information already shown in the order form.
2.3 Radino shall process your purchase order after your order form has been submitted.
2.4 Before submitting the order form related to either Radino wine or any other product sold on www.Radino.it., you shall be asked to check your personal data, to correct any mistake and to read carefully the terms and conditions of sale, including the right of withdrawal, and either to save or print a copy thereof for your own personal use.
2.5 The contract is written in Italian. The English translation of the contract is also available.
2.6 Radino may not process purchase orders when there are not sufficient guarantees of solvency, when orders are incomplete or incorrect, or when the products are no longer available. In the cases above mentioned, Radino shall inform you via e-mail that the contract has not been executed and that Radino has not processed your purchase order specifying the reasons thereof and suggesting a possible solution.
2.7 If any bottle of wine or product displayed on www.Radino.it is no longer available at the time the order form is submitted, Radino shall promptly inform you of the unavailability of either the whole “Selezione Radino” (Radino Selection) or of the single bottles included in the “Selezione Radino” or any other product, within a maximum period of 30(thirty) days from the day after Radino received your order. If you have already submitted the order form and paid the amount due, Radino shall, first of all, suggest an alternative product, that has the same commercial value as the product ordered or a higher value than the product ordered, to meet your requirements. Alternatively, Radino shall refund you the amount paid in advance.
2.8 By submitting the order form by e-mail you unconditionally accept and undertake to comply with Radino’s terms and conditions of sale. If you do not agree to comply with Radino’s terms and conditions of sale, please do not submit any order form for the range of Radino’s products as well as for all the products sold on www.radino.it
3. GUARANTEES AND PRICES OF WINES AND OTHER PRODUCTS AVAILABLE FOR SALE.
3.1 All Radino Selections, all bottles of wine and in general all the products sold by Radino on www.Radino.it , shall be deemed exclusively “premium” and top-quality products. The products are the result of accurate and constant research and the wine is directly produced by Radino in its winery. Radino does not sell any products, which are not in compliance with the law, or of lower quality than the market quality standards.
3.2 All the information and data shown on the labels of the bottles of wine sold by Radino are in compliance with the law and are made and guaranteed by “Az.Agr. Radino srl”. For any doubt or enquiry please contact us directly at email@example.com. The company will promptly provide any further guarantee or any further information as required.
3.3 The main characteristics of the products sold by Radino are described in the relative data sheets available on www.radino.it. However, the pictures and colours of the products available on www.radino.it may not exactly correspond to the real ones due to the internet browser or monitor used. Furthermore, the section “Selezione Radino” (Radino Selection) may be subject to updates and modifications, thereby offering quality wines in compliance with the characteristics of the products displayed in “Selezione Radino”.
3.4 The prices shown are all VAT included. To ensure more transparency, transport costs are shown separately both in the order form and in the invoice. Since the prices may be subject to change, we recommend that you check the final sale price before submitting the order form.
3.5 The products included in “Selezione Radino” and in general all the products sold by Radino are delivered only to the listed countries. Therefore, we kindly ask you to check the list of the countries where Radino can currently ship the products. Any order from countries which are not included in the list cannot be accepted by Radino. The company shall periodically update the list of the countries. Please check periodically the geographic areas served by Radino on www.radino.it.
3.6 In case of faulty goods, please inform us promptly by sending an email to firstname.lastname@example.org or by calling the number +39 0835.334519, +39 338.5882673. We will immediately check the problem and work out a solution with you. Faulty goods shall be returned to Radino in their original packaging within 15 days from the delivery. You shall bear all shipping and packaging costs. Radino shall replace and ship any faulty goods or refund the amount paid for the goods if they are no longer available.
3.7 If you decide to exercise you right to withdraw from the contract, Radino may not accept the returned products whose main qualitative characteristics have been altered, damaged or partly consumed.
4.1 The payment terms and conditions relative both to wines and to the wines included in “Selezioni Radino” and sold on our www.radino.it are described in the order form.
4.2 The selling price includes the shipping costs – which are not included in the total amount – and shall be charged on your current account upon the shipping of products, as described in the order form.
4.3 Payments can be made by either credit/debit card or by bank transfer. All details required for the transaction shall be sent by encrypted protocol, either to banks or credit card companies which provide remote electronic payment services without third parties having any access thereto whatsoever. Such details shall never be used by Radino except for completing the procedure related to your purchase or for issuing refunds in the case of returns in compliance with the exercise of your right of withdrawal, or for reporting cases of fraud to the police, which were detected on www.radino.it.
5. SHIPPING AND DELIVERY OF THE PRODUCTS
5.1 Radino delivers bottles of wine and other products available for sale on www.Radino.it exclusively to its end users qualified as “consumers” who are over 18 (eighteen) and in compliance with the rules and regulations in force.
5.2 Radino uses patented packaging that ensures the integrity of the products during shipping thanks to its particular characteristics. Radino delivers the products to the address indicated in the order form submitted through the www.radino.it. Radino avails itself of the best national and international carriers- UPS, FedEx, AWS, Bartolini, SDA, GLS, MBXets. They are responsible for the delivery from the collection of the products at our company up to the delivery to the address indicated. Radino is not responsible for any damage or misbehaviour of the carriers.
5.3 Deliveries are made only to the countries listed on www.radino.it. Radino updates the list of the countries regularly. Therefore, we suggest to check whether delivery is carried out to the country required before filling out the order form.
5.4 The following details are required for the delivery of the products:
- Invoice details, i.e. the customer name, address and e-mail address to use to send the invoice.
- Delivery details, i. e. Delivery address, customer name, telephone and e-mail address.
5.5 If you receive packages by Radino which are visibly broken, damaged by the carrier or stained by the leakage of wine resulting from broken bottles, please do not hesitate to refuse the goods. Radino shall return the products and replace them. If the package is made up of more parcels and not all of them are damaged, please return the damaged parcel(s) to the sender by signing the delivery form of the carrier with the mention: “Conditional Acceptance”.
Radino shall collect the damaged parcels and replace them. If the products to be replaced are no longer available, we shall contact you directly to suggest either a substitution with another product or the refund of the residual value. Radino shall pay the shipping costs to collect the damaged parcel and deliver the new one to you.
5.6 Delivery usually takes place from Monday to Friday, within 3/5 working days from submitting the order through www.radino.it that shall be paid by credit card. If the payment is made by bank transfer, the delivery shall be carried out within the same period of time from the acknowledgement of receipt of the bank transfer.

7. INFORMATION ON THE RIGHT OF WITHDRAWAL
7.1 Pursuant to Legislative Decree 206/05, you are entitled to withdraw from the purchase order of our products, free of charge, within 10 working days from the delivery of the goods and to send written notice to “Az. Agr. Radinosrl”, in compliance with the terms and conditions relative to the return of the product as set forth by Radino. However, the substitution of the single bottle of wine, or of the wine selection chosen with another one is not free of charge. 7.2 Your e-mail shall mention the product or the products for which you want to exercise the right of withdrawal, the number and the date of the order, the invoice number, your bank details (IBAN code). Following your e-mail, you will be asked to wait until the Customer Service sends you an authorization notice to return the product. Then you can contact the Carrier that shall ship the goods within 10 working days starting from the date of receipt of the goods provided that they are intact and delivered according to the terms and conditions agreed upon, unless you decide not to return the above mentioned products.
7.3 You shall pay only the costs concerning the return of the goods pursuant to art. 5, paragraph 6, Legislative Decree n. 185 of 22nd/05/1999.
7.4 In compliance with the terms and conditions set forth in paragraphs 7.1, 7.2, and 7.3., the right of withdrawal is properly exercised if the following conditions are fulfilled:
- the purchased products shall be substantially intact;
- they shall be returned in their original packaging. Due to the special characteristics of the products included in “Selezioni di vino”, it is necessary to return all the bottles included in the case);
- the returned products shall be delivered to Radino in the same shipment. Radino reserves the right not to accept any bottles or any products belonging to the same order that are returned in a different time;
- the shipping costs for returning the goods shall be at your expense, including the responsibility in case of loss or damage of the products.
- Upon the delivery of the goods at the storehouse, the products shall be checked to see whether they have been damaged or opened. The goods must be intact since this is an essential condition to claim the right of withdrawal. Please pay the utmost attention during packaging;
- The products must not have been either damaged or used;
- The right of withdrawal is reserved to individuals, defined as “consumers” in paragraph 1.2. above. Therefore, any purchase orders submitted by sellers or individuals who purchase the products for sale are excluded.
- The return form shall be duly filled out and submitted to Radino within ten (10) working days from the delivery of the goods.
7.5 The right of withdrawal shall be properly exercised only if in compliance with the terms and conditions indicated in paragraph 7. Radino shall refund any amount of money which has already been paid for the products directly purchased on the www.radino.it within the shortest delay possible and within thirty (30) days from the date Radino has acknowledged receipt of your right of withdrawal. The refund procedure shall be activated after checking that all above terms and conditions have been fulfilled as indicated in paragraph 8.
7.6 If the terms and conditions to exercise the right of withdrawal have not been fulfilled, you shall not be entitled to the refund of the amount you have already paid to Radino, nor to the credit requested. However, you shall be entitled, at your expense, to receive the products in the conditions they were returned to Radino. Alternatively, the company shall be entitled to keep the products and withhold the amount of money already received for their purchase.
8. REFUND TIMES AND PROCEDURES
8.1 Once the products have been returned, Radino shall check the compliance of the products with the terms and conditions indicated in paragraph 7. When Radino is able to confirm that such conditions have been met, Radino shall send you an e-mail confirming the acceptance of the returned products.
8.2 Regardless of the method of payment used, Radino shall refund you within the shortest delay possible and within thirty (30) days from the acknowledgement by Radino of your request to exercise your right of withdrawal, after checking the compliance with the terms and conditions above mentioned and the acceptance of the returned products.
8.3 If the name of the recipient of the products indicated in the order form does not match the name of the person who made the payment, Radino shall refund the individual who made the payment.
10. GOVERNING LAW AND SETTLEMENT OF DISPUTES
10.1 The Terms and Conditions of Sale are governed by Italian Law and in particular by the Legislative Decree n. 206 of 6th September 2005, on the Consumer Code with specific reference to the laws in force governing distance contracts and the Legislative Decree n. 70 of 9th April 2003 on some aspects related to e-commerce.
10.2 10.3 As the sale of products/supply of services takes place in Italy, this contract is governed by the Italian laws in force. Any dispute arising out of the contract shall be settled by the Court of Matera.
11. AMENDMENTS AND UPDATES
11.1 The Terms and Conditions of Sale are regularly updated and amended according to the development of the business and the market and in compliance with the amendments and changes to the relative law. Any update or amendment shall be duly published on www.radino.it and shall be effective immediately after the publication on www.radino.it.
